Personal Data and Browser Data


Important Definitions
• When we use the term "Personal Information" in this Privacy Policy, we mean information about you that is personally identifiable to you, such as your contact information (e.g., name, address, email address, or telephone number), personally identifiable health or medical information ("Health Information"), and any other non-public information that is associated with such information. When we use the term "De-Identified Information", we mean information that is neither used nor intended to be used to personally identify an individual. Lastly, when we use the term "Cookies", we mean the small pieces of information that a Site sends to your browser while you are viewing a website.

Children under age 18
• We do not knowingly allow individuals under the age 18 to create accounts that allow access to Telacoach®. An individual under 18 years of age may use the app only if the account was created by an adult parent and may do so only under parental supervision. An example may be a parent who uses Telacoach® to hire an academic coach to offer tutoring service to a minor.

• The Personal Data and Browser Data (hereinafter collectively referred to as "Data"), automatically gathered from the app and our website (hereinafter referred to as "the Site" or "the App"), by means of automated systems or freely entered by the User of this Site.

• Our user's privacy is extremely important to us. Our Privacy Policy provides important disclosures about your use of Telacoach® and how your information is collected and used.

• We receive a number of different types of information about you, including:
o The information that we ask for when you sign up for the app, as well as the information you choose to share.

o Required information such as your name, email address, birthday, and gender. We use return email addresses to answer the email we receive. We do not use such addresses for any other purpose and do not share with outside parties.

o Usernames and User IDs, which are used to identify you on Telacoach®. A User ID is a string of numbers and a username.

o "Public Information" which means the information you choose to make public, as well as information that is always publicly available.

• Information posted to a group chat or moderated session and information kept within a one on one session.

• “Contact Information” is personal information and or family/friend/relation that is stored confidentially by your Coach to access in case of an emergency or mental health crisis.

• “Coach” refers to Coaches, Therapists, and other professionals featured on the app.

• Parties processing the data Telacoach® is a "DBA" used by Kind Mobile Corporation, which manages the app and site and maintains the Data.

• We will keep your information confidential except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies or during an emergency circumstance as judged by your Coach working with local authorities). Generally, we will only use your information within our company. However, sometimes we use third parties to process your information (for example as credit card payment providers). We will require these third parties to comply strictly with its instructions and we will require that they not use your personal information for their own business purposes.

The Uses of the Data Collected by Telacoach®
• Telacoach® uses non-identifying and aggregate information to better design our Web site and to use in research and trend analysis. For example, we may tell an advertiser that X number of individuals visited a certain area on our Web site, or that Y number of men and Z number of women filled out a site survey or form, but we would not disclose anything that could be used to identify those individuals. We only provide data to our partners, if any, after we have removed your name and any other personally identifying information from it, or have combined it with other people's data in a way that it no longer personally identifies you.

• The anonymous and aggregated data also may be published through various media platforms/academic journals. No personal identifying information will be tied to the results, and Telacoach® will not share anything that could be used to identify your account or your private information.

• From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will contact you before we use your data for these new purposes to notify you of the policy change and to provide you with the ability to opt out of these new uses.

• Telacoach® stores data only for as long as it is necessary to provide products and services to you and others, including those described above and for legal protections or as required by applicable laws and regulations.

• Telacoach® may enable access to public information that has been shared through our services.

• Telacoach® may allow service providers to access information so they can help us provide services.

• We may also disclose your information to our subsidiaries and affiliates.

• To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential.

• As required by law, which can include providing information as required by a court order.

• When we believe in good faith that disclosure is necessary to protect your safety or the safety of others, to protect our rights, to investigate fraud, or to respond to a government request.

• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Telacoach®'s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information maintained by the Site is among the assets transferred.

• For any other purpose disclosed by us when you provide the information.

• IP addresses may be used to identify the location of users, the number of visits from different countries and also to block disruptive use; and to analyze and improve the services offered on our website, e.g. to provide you with the most user-friendly navigation experience.

• Telacoach® reserves the right to deactivate or delete any profiles that do not include a photograph of the coach.

• Certain information is needed to provide you with services, so we only delete this information after you delete your account.

• Some forms of processing (sending promotional information, commercial profiling, behavioral advertising, geo-location, etc.) may require the express consent of the User. Specific information may be shown on the pages of the Site in connection with particular services or processing of Data provided by the Site User.

• Telacoach® uses industry-standard encryption technologies when transferring and receiving consumer data exchanged with our site. If you feel that this site is not following its stated information policy, you may contact us at info@Telacoach.com or Sales@Telacoach.com.

• For content that is covered by intellectual property rights, like photos and videos you specifically grant Telacoach® a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with the Telacoach® app or Telacoach (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it. This Paragraph does NOT apply to photos, images or other videos shared ONLY with your Coach in your private session/s while on the Platform.

• Protecting the Privacy of your fellow TelaCoach Users

• During your use of Telacoach services, you will not send or otherwise post unauthorized commercial communications (such as spam) on Telacoach®.

• You will not collect users' content or information, or otherwise access Telacoach®, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission:

o You will not run malicious software, code, or viruses on the app or site.

o You will not solicit login information or access an account belonging to someone else.

o You will not abuse, bully, intimidate, or harass, or impersonate another User.

o You will not post content that is threatening, racist, hateful, pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

• You will not provide any false personal information on Telacoach®, or create an account for anyone other than yourself without permission. You will not create more than one personal profile. You will not attempt to another user's account unless they have given you permission. You will not change the name that you registered with after you have already been approved for the app.


Telacoach® and Protecting Other People's Intellectual Property Rights

• Here at Telacoach®, we respect other people's rights, and expect users of the app to do the same. You will not post content or take any action on Telacoach® that infringes or violates someone else's rights or otherwise violates the law. You will be held liable for any action or postings that are deemed harmful to other users. We can remove any content or information you post on Telacoach® if we believe that it violates this Privacy Policy or the Terms of Use on this Site. You will not use our copyrights or any confusingly similar marks, without our written permission. If you collect information from Telacoach® Users, you will: obtain their consent, make it clear you (and not Telacoach®) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it. You will not post anyone's identification documents or sensitive financial information on Telacoach®. You will not tag Telacoach® fellow Users or send email invitations to non-users without their consent. You will not pretend to represent Telacoach® or enter into business transactions on behalf of the Telacoach®.

Portable Electronic Devices
• The Telacoach® Platform is available on a variety of portable electronic devices. We provide our connection to mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging fees, may still apply. You provide all rights necessary to enable Telacoach® Users to sync (including through an application) their contact lists with any basic information and contact information that is visible to them on Telacoach®, as well as your name and profile picture.

Your Use of Your Personal Data
• If a Telacoach® User utilizes the Platform to publish or otherwise share their own Personal Data or Contact Information with third parties, he or she assumes full responsibility for any further use of that Data or information.

• Arbitration of disputes. Client and Company agree to arbitrate all disputes and claims between Client and Company that arise out of or relate in any manner to the Telacoach® app platform and website, the Telacoach® Certification program, or any other services provided, supported, or endorsed by the Company.

This Dispute Resolution Agreement does not preclude any party from seeking an individualized preliminary injunction or a temporary restraining order until a claim is arbitrated, or from bringing an individualized action in small claims court, in any court that has jurisdiction; provided that the arbitrator will have exclusive jurisdiction to finally resolve claims not within the jurisdiction of a small claims court. This Dispute Resolution Agreement also does not forbid Client or Company from bringing issues to the attention of federal, state, or local agencies. Client and Company agree that, by entering into this arbitration agreement, all parties are waiving their respective rights to a trial by jury or to participate in a class or representative action.

The Federal Arbitration Act governs the interpretation and enforcement of this Dispute Resolution Agreement. With respect to all disputes or claims that arise out of or relate in any way to the Telacoach® app, the Telacoach® website, the Telacoach® Certification program, or any services provided or supported by the Company, this Dispute Resolution Agreement supersedes any contrary terms regarding dispute resolution in any other agreement between the parties

• If anyone brings a claim against us related to your actions, content or information on Telacoach®, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

Social Networks and Telacoach®
• These services allow the web site to access the data on your profile in the social networks, and to interact through your post. These services are not activated automatically, but require express authorization by the User.

• Telacoach® Users can share information and Data supplied to the Telacoach® app and Site with the social networks with which the User is registered, accepting their privacy policy. Facebook social buttons/widgets (Facebook) Facebook Social button is a service run by Facebook Inc., a company that complies with the “Safe Harbor” Privacy Policy Framework initiative, guaranteeing the handling of Personal Data.

• Twitter is managed by Twitter, a company that complies with the “Safe Harbor” Privacy Policy Framework initiative, guaranteeing the handling of Personal Information.

Cookies on Telacoach®
• A cookie is a small amount of data, which often includes a unique identifier that is sent to your computer, tablet, phablet, cell phone or other electronic device (referred to here as a "device") browser from a website's computer and is stored on your device's hard drive. Each website can send its own cookie to your browser if your browser's preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites. Many sites do this whenever a user visits their website in order to track traffic flows.

• Cookies record information about your preferences and allow us to tailor Telacoach® to your interests. During the course or any visit to the Site, the pages you see, along with a cookie, are downloaded to your device. Many websites do this, because cookies enable website publishers to do useful things such as finding out whether the device (and probably its user) has visited the website before. This is done on a repeat visit by checking for the cookie left there on the previous visit.

• Information supplied by cookies can help us to analyze the profile of our visitors so we can provide you with a better user experience.

• Personal identifying information: Name, address, credit card number

• We try to keep Telacoach® safe, but you use it at your own risk. We are providing Telacoach® “As Is” without any express or implied warranties. We do not guarantee that Telacoach will be safe or secure. Telacoach is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.

• We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. You consent to having your personal data transferred to and processed in the United States. If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on Telacoach® (such as advertising or payments) By content we mean anything you post on Telacoach that would not be included in the definition of information. By data we mean content and information that third parties can retrieve from Telacoach or provide to Telacoach through Platform. By post we mean post on Telacoach or otherwise make available to us (such as by using an application). By use we mean use, copy, publicly perform or display, distribute, modify, translate, and/or create derivative works.

• Telacoach® openly volunteers its practices of collecting information, its targeting capabilities, and its use of cookies. If you have any questions pertaining to this privacy policy and its contents, please direct your correspondence to Telacoach at the "contact us" link on the website.

• We keep all information not disclosed above private between the Coach and the User, keeping only non-decimated "file" copies for reference in case of legal dispute of by court order as we are required to under Federal Laws for period up to seven years or by the applicable State Regulation. File retention protects both the User and the Coaches safety. Telacoach® is not responsible for data lost/exposed/used due to the nature of the Internet and digital environments, including illegal actions of hackers and criminals, technical malfunctions of servers and database etc. These are the accepted risks of our Users and users of the Internet in general. You are agreeing to this standard in using our site.

• Telacoach® reserves the right to change our Privacy Statement and Terms and Conditions at any time without notice, and only the current Privacy Statement and Terms and Conditions may be considered effective. Regardless of later updates or changes to our privacy notice, we will never use the information submitted under our current privacy notice in a new way without issuing you the opportunity to opt-out or otherwise prevent that use.

• Telacoach® offers a Certification program known as the Recommended Sticker program. Telacoach® also offers the Certified Transformational Coach (CTC) in partnership with the International Academy of Coaching, The International Academy of Coaching is a training platform owned by Kind Mobile Corporation, the same company which owns Telacoach®. If you decide to request certification and become certified by Telacoach®, you agree that the certification does not guarantee an increase in your client bookings either from or outside the Telacoach® app. You also agree that the certification may or may not involve coach training and that certification by Telacoach® will not lead to premium placement of your profile in the app. You understand that certification by Telacoach® is not required before you can be featured on the app.

• Telacoach® reserves the right to deactivate any user accounts that are not in compliance with Telacoach®’s terms and conditions.

• Where there is a subscription plan, Clients will be charged for the first full month of the recurring monthly subscription plan if they cancel. No refunds will be issued for any sessions booked but not used in the recurring subscription plan. By signing up for the plan, user agrees to the terms.

• Clients will be charged the full amount for single session bookings, if they cancel. There will be no refunds. By signing up for the plan, user agrees to the terms.

• While we may try to do so from time to time, at our sole discretion, you acknowledge that we do not represent to verify, and do not guarantee the verification of the skills, degrees, qualifications, licensure, certification, credentials, competence, or background of any Coach on the Telacoach® app.

• You agree that it is your responsibility to independently verify the credentials, certification, qualifications, licensure, competence, or professional history of any coach on Telacoach®. We recommend that you conduct this verification before booking a session with any coach and urge you to continue to verify all coaches as you use the Telacoach® app. Telacoach does not make any representations or warranties relating to the accuracy, status, currency, and validity of the qualifications, licensure, professional history, credentials, or certifications of any coach or therapist featured on the app.

• The information provided on the Telacoach® website (the Site) and mobile application (the App) is for general informational purposes only. All information on the Site and App is provided in good faith. Telacoach® makes no representation or warranty of any kind, express or implied, regarding the accuracy, validity, adequacy, availability, reliability, or completeness of any information on the Site or the App.

Under no circumstance can Telacoach® be held liable for any loss or damage suffered as a result of the use of the Site or App. You understand that your use of the Site and App and your reliance on any information therein is solely at your own risk.

The Site and App contain services offered by third parties. You understand that representations made by such service providers are not investigated, monitored, or checked for accuracy, validity, adequacy, reliability, availability or completeness by Telacoach®.

We do not guarantee, warrant, endorse, or assume responsibility for the accuracy, integrity, or reliability of any information offered by third-party service providers on the Telacoach® App or Telacoach® website. You agree that Telacoach® will not be responsible for monitoring any transactions and interactions between you and third-party providers of services, nor will Telacoach® be party to such transactions and interactions.

Any legal, academic, medical, fitness, financial, health or other information provided on the Telacoach® site and App is provided for general informational and educational purposes only and is not a substitute for professional advice.

Before taking any actions based upon such information, we encourage you to consult with the appropriate professionals. The use or reliance of any information contained on our website and mobile app is solely at your own risk.

No Attorney–Client Privilege:
No attorney-client privilege is created when a client contacts Telacoach® through its mobile application or website. Emails, contact forms, or chats submitted through the website and mobile application are not confidential.

Any advice and information provided by any professionals on Telacoach® (coaches, advisors, consultants, nurses, doctors, lawyers, accountants, etc) is provided for educational purposes only. Any medical or health information provided should not be substituted for medical advice from a qualified healthcare provider.

• You agree that any advice received from Telacoach® does not constitute medical, health, legal, financial, or any other type of professional advice. You agree that Telacoach® does not purport to provide, or intend to provide medical, health, legal, financial, or any other type of professional advice. You agree that any actions that you decide to take as a result of advice provided by any coach or therapist on the Telacoach® app are taken at your own risk and your own volition.

• You agree that you will not attempt to contact the coaches and therapists featured on the app outside of the app to book coaching or therapy sessions. You agree that carrying out such an action constitutes a violation of Telacoach®’s terms of use.

• You agree not to provide your personal confidential information to any individual who may be a coach or therapist or may be representing themselves as a coach or therapist on Telacoach®.

• Telacoach® offers four rate plans for coaches based on the coach's level of experience. The Basic Plan charges $39.90 for one hour. The Standard Plan charges $59.90 for one hour. The Premium Plan charges $99.90 for one hour. The Premium Plus Plan charges $279.00 for one hour.

Coaches who choose to be booked for 30-minute sessions will earn half the hourly rate. Payment is remitted to the coach within 2 business days after the session. Telacoach® collects a commission of 20% from each session booked by the coach, deducts credit card processing fees of 2.90% plus $0.30c per transaction, and then remits the balance to the coach’s bank account.

Rate Plans and Payment
• You agree as a coach or client that Telacoach® has the right to increase or decrease pricing at any time, and reduce or increase rate plans at any time.

• You agree as a coach or client that Telacoach® has the right to change a coach’s selected rate plan to a category that Telacoach® believes that the coach is more qualified for.

• The Client agrees that the Coach is not liable and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands that coaching is not therapy and that it is not a substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease. Client agrees that therapists on Telacoach® are not legally liable for any therapy advice issued via Telacoach®. Client agrees to indemnify and hold harmless Telacoach® as well as the coaches and therapists on Telacoach® from any lawsuits arising from the Client’s use of the Telacoach®.

Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time.

Client acknowledges that the decisions on how to handle issues relating to life, work, health, relationships, business, etc., are entirely up to the Client. While the coach may provide advice, such advice is not binding on the client, and the Coach cannot be held liable for the consequences of actions taken by the client as a result of the advice from the coach.

Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be a substitute for counseling, mental health care, psychotherapy, substance abuse treatment, psychoanalysis, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional help when needed. If Client is currently under the care of a mental health professional, the Client should inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.

The Client agrees to communicate honestly with the coach, be open to feedback and responsive to constructive advice.

Fees paid by clients for coaching are non-refundable once the coach has accepted and booked the session.

Confidentiality - The Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent.

Confidential Information does not include information that:

(a) was in the Coach’s possession prior to its being provided by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently obtained by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

• Client acknowledges that the Coach has disclosed his/her record retention policy with respect to documents, information and data acquired or shared during the term of the Coach-Client relationship.

Dispute Resolution:Arbitration of disputes.
Client and Company agree to arbitrate all disputes and claims between Client and Company that arise out of or relate in any manner to the Telacoach® app or any of the certification programs offered by Telacoach®, such as the Certified Transformational Coach certification program, or the Certified Master Transformational Coach program.

• This Dispute Resolution Agreement does not preclude any party from seeking an individualized preliminary injunction or a temporary restraining order until a claim is arbitrated, or from bringing an individualized action in small claims court, in any court that has jurisdiction; provided that the arbitrator will have exclusive jurisdiction to finally resolve claims not within the jurisdiction of a small claims court. This Dispute Resolution Agreement also does not forbid Client or Company from bringing issues to the attention of federal, state, or local agencies.

• Client and Company agree that, by entering into this arbitration agreement, all parties are waiving their respective rights to a trial by jury or to participate in a class or representative action. The Federal Arbitration Act governs the interpretation and enforcement of this Dispute Resolution Agreement. With respect to all disputes or claims that arise out of or relate in any way to the Telacoach® app or any of the certification programs offered by Telacoach® (such as the Certified Transformational Coach program, the Certified Master Transformational Coach program) or any other programs, this Dispute Resolution Agreement supersedes any contrary terms regarding dispute resolution in any other agreement between the parties.

• Severability If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

Waiver The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

Applicable Law: This Agreement shall be governed and construed in accordance with the laws of the State of Texas without giving effect to any conflicts of law provisions.

Binding Effect:
This Agreement shall be binding upon the parties hereto and their respective successors and permissible assigns.

By using this app, you agree to the above terms and conditions and all other terms and conditions governing usage of the Telacoach® app.


About Our Privacy Policy
• This Privacy Policy is intended to inform you about how we treat Personal Information that we process about you. If you do not agree to any part of this Privacy Policy, then we cannot provide the Platform or Services to you, and you should stop accessing the Platform and deactivate your Telacoach® Account.Telacoach® (“Telacoach®,” “we,” “our,” and/or “us”) values the privacy of individuals that use our application, websites, and related services (collectively, the “Telacoach® Platform ”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and share information from Telacoach® users (“Users”). In addition to our Privacy Policy, your use of Telacoach® is also subject to our Terms of Service

• Where the definition of a term does not appear in this Privacy Policy (such as “Listing”, “Accommodation”, “Content,” “Services” etc.), it shall be given its definition as outlined in our Terms of Service.

"Affiliates” means companies related by common ownership or control. They can be financial and non-financial companies.

“Aggregated Information” means information about all of our users or specific groups or categories of users that we combine together so that it no longer identifies or references an individual user.

“Data Controller” means Telacoach®, the company responsible for the use and processing of Personal Information.

“Third Parties” means companies or persons not related by common ownership or control (i.e. non-affiliates) or other unrelated individuals. Third Parties can be financial and non-financial companies, or persons other than you and Telacoach®.

“Personal Information” means information (which may include sensitive information) relating to a living individual who is or can be identified either from that information or from that information in conjunction with other information that is in, or is likely to come into, the possession of the Data Controller.

Information We Collect
A. Information You Provide to Us

Registration Information. When you sign up for a Telacoach® account, you give us your name, email address, and phone number. If you decide to sign up for Telacoach® using your Facebook account, we will also get basic information from your Facebook profile like your name, gender, profile photo, and Facebook friends.

User Profile Information. When you join the Telacoach® community, you can create a Telacoach® Profile to share information about yourself. Filling out a profile is optional. Your name and profile photo are always a part of your Profile.

Payment Method. When you add a credit card or payment method to your Telacoach® account, a third party that handles payments for us will receive your card information.

Communications. When you contact us, we may require additional information from you. For example, when you contact our Customer Support Team, we will receive your name, email address, phone number, the contents of a message or attachments that you sent to us, and other information that you choose to provide.

Payment Information. Telacoach® may store information about your bank routing numbers, credit card information, tax information, and any other payment information.

B. Information We Collect When You Use the Telacoach® Platform

Location Information. Telacoach® may use GPS and Google Nearby technology to determine your location. When you open Telacoach® on your mobile device, we will receive your location. We may also collect the exact location of your device when the app is running in the foreground or background. Your location information is necessary for matching users of the app. If you give us permission through your device settings or Telacoach® app, we may collect your location while the app is off to identify service updates in your area.

Device Information. Telacoach® receives information from Users’ devices, including IP address, web browser type, mobile operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, push notification tokens, and, if you register with your Facebook account, your Facebook identifier.

Usage Information. To help us understand how you use the Telacoach® Platform and to help us improve it, we automatically receive information about your interactions with the Telacoach® Platform, like the pages or other content you view, your actions within the Telacoach® app, and the dates and times of your visits. • Address Book Contacts. If you allow Telacoach® to access the address book on your device through the permission system used by your mobile platform, we may access and store names and contact information from your address book in order to process invitations and for other purposes described in this privacy policy or at the time of consent or collection.

Information from Cookies and Similar Technologies. We collect information through the use of “cookies”, tracking pixels, and similar technologies to understand how you navigate through the Telacoach® Platform and interact with Telacoach® advertisements, to learn what content is popular, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Telacoach® Platform. You should consult phone’s web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Telacoach® Platform. You do have the ability to delete or not accept cookies from Telacoach®.

C. Information We Collect from Third Parties

Third Party Services. If you choose to register for Telacoach® or otherwise link your Telacoach® account with a third party’s service (such as Facebook), we may receive the same type of information we collect from you (described above) directly from those services.

Third Party Partners. We may receive additional information about you, such as demographic data, payment information, or fraud detection information, from third party partners and combine it with other information that we have about you.

How We Use the Information We Collect

We use the information we collect from all Users to:

o Connect users of Telacoach®

o Provide Customer Support

o Analyze usage of the Telacoach® Service

o Communicate with you, either directly or through one of our partners, including for marketing and promotional purposes

o Personalize the Telacoach® experience for you and your friends and contacts

o Send you text messages and push notifications

o Facilitate transactions and payments

o Find and prevent fraud o Respond to trust and safety issues that may arise, including incidents and disputes and requests from government authorities.

o Collect for the following purposes related to driving on the Telacoach® Platform

o Send emails and text messages to users who have installed the Application

How We Share the Information We Collect

A. Sharing Between Users

• Sharing between Users: Users are able to see basic Profile information about each other, such as names, photo, and geographical location. Users who connect their Telacoach® accounts to Facebook will also be able to see their mutual Facebook friends. Although we connect Users, we do not share your actual phone number or other contact information with other Users.

B. Sharing Between Telacoach® and Third Parties

API and Integration Partners. When you connect to the Telacoach® Platform through an integration with a third party service, we may share information about your use of the Telacoach® Platform with that third party. We may share your information with our third party partners in order to receive additional information about you. We may also share your information with third party partners to create offers that may interest to you.

Service Providers. We work with third party service providers to perform services on our behalf, and we may share your information with such service providers to help us provide the Telacoach® Platform, including all of the things described above.

Other Sharing. We may share your information with third parties in the following cases:

o If requested by a government authority as part of a legal investigation.

o While negotiating or in relation to a change of corporate control such as a restructuring, merger or sale of our assets;

o With law enforcement officials, government authorities, or third parties if we think doing so is necessary to protect the rights, property, or safety of the Telacoach® community, Telacoach®, or the public

o To provide information about the use of the Telacoach® Platform to potential business partners in aggregated or de-identified form that can’t reasonably be used to identify you;

o Whenever you consent to the sharing.


• For California & Vermont residents: Telacoach® Payments will not share information it collects about you with Affiliates or Third Parties, except as required or permitted by your state’s law.

Your Choices

Email Subscriptions. You can always unsubscribe from our commercial or promotional emails but we will still send you transactional and other emails about your account use of the Telacoach® Platform.

Text Messages. You can opt out of receiving commercial or promotional text messages by texting the word STOP in response to text messages. You may also opt out of receiving all texts from Telacoach® by texting the word STOPALL from the mobile device receiving the messages, however, opting out of receiving all texts may impact your use of the TelaCoach Platform. To re- enable texts you can text START in response to an unsubscribe confirmation SMS.

Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of the Telacoach® Platform.

Profile Information. While your name will always be shared with users of the Application, you can delete any additional information that you added to your Profile at any time if you don’t want users of the Application to see it. Users will always be able to see the names and profiles of other users. Users can be searched by name, email address or user name.

Location Information. While you can prevent your device from sharing location information at any time through your Device’s operating system settings, identifying the location of users of Telacoach is crucial to the functionality of the Telacoach® Platform. Without this feature, it may be difficult to provide our services to you.

Facebook Friends. You can control whether to enable or disable the Facebook mutual friends feature through your profile settings. • Editing and Accessing Your Information. You can review and edit certain account information by logging in to your account settings and profile. If would like to terminate your Telacoach® account, please notify us through our Help Center. If you choose to terminate your account, we will deactivate it for you but may retain information from your account for a certain period of time and disclose it in a manner consistent with our practices under this Privacy Policy for accounts that are not closed. We also may retain information from your account to collect any fees owed, resolve disputes, troubleshoot problems, analyze usage of the Telacoach® Platform, assist with any investigations, prevent fraud, enforce our Terms of Service, or take other actions as required or permitted by law.

OtherData Protection. We strive to implement and update administrative, technical, and physical security measures to help protect your Personal Information against unauthorized access, destruction or alteration. However, no method of transmission over the Internet, and no method of storing electronic information, can be 100% secure. So, we cannot guarantee the security of your transmissions to us and of your Personal Information that we store.

Children’s Privacy. Telacoach® is not meant to be used by children or aimed at children. The exception might be when a parent or guardian books a therapy session or tutoring session for their child. We do not intentionally collect personal information from children under 13. If we find out that a child under 13 has given us personal information, we will take steps to delete that information. If you believe that a child under the age of 13 has given us personal information, please contact us at our Help Center.

As long as you use the Telacoach® Platform, you are agreeing to this Privacy Policy and any updates we make to it.
